विधिको शासन (Rule of Law)कानुनद्वारा शासन (Rule by Law) बीचको मुख्य भिन्नता तिनीहरूको उद्देश्य र प्रयोगमा छ। विधिको शासनमा कानुन न्यायको आधार हो भने, कानुनद्वारा शासनमा कानुन नियन्त्रणको हतियार हो

यी दुई बीचका मुख्य भिन्नताहरू यस प्रकार छन्:

१. कानुनको सर्वोच्चता र समानता:

विधिको शासन: यसमा कानुन सबैभन्दा माथि हुन्छ र सबैलाई समान रूपमा लागू हुन्छ। प्रधानमन्त्री होस् वा सामान्य नागरिक, गरिब होस् वा धनी, सबैका लागि एउटै नियम र न्याय हुन्छ। यहाँ सरकार र शासकहरू पनि कानुनको अधीनमा बाँधिएका हुन्छन्।

कानुनद्वारा शासन: यसमा शासकहरू कानुनभन्दा माथि हुन सक्छन् वा आफ्नो सुविधाका लागि कानुन परिवर्तन गर्न सक्छन्। कानुन सबैका लागि समान हुँदैन; यो कमजोरमाथि कडा र शक्तिशालीमाथि नरम हुन्छ। यसमा जसलाई दबाउन चाहियो उसलाई कानुन प्रयोग गरिन्छ भने जसलाई बचाउन चाहियो उसलाई छुट दिइन्छ।

२. नागरिकको अवस्था र अधिकार:

विधिको शासन: यसले नागरिकको अधिकार र स्वतन्त्रताको रक्षा गर्छ। यस व्यवस्थामा नागरिकहरू सुरक्षित हुन्छन् र कानुन उनीहरूका लागि एउटा बलियो 'ढाल' बन्छ।

कानुनद्वारा शासन: यसले नागरिकलाई नियन्त्रण गर्छ र स्वतन्त्रतामा अंकुश लगाउँछ। यसमा नागरिकहरू डराएका हुन्छन् र कानुन शासकहरूको शक्ति प्रदर्शन गर्ने 'हतियार' बन्छ।

३. समग्र प्रभाव र बाटो:

विधिको शासनले देश बनाउँछ र यो एउटा खुला तथा उज्यालो बाटो जस्तै हो।

कानुनद्वारा शासनले देशलाई नियन्त्रण गर्छ र यो जाल र काँडाले भरिएको बाटो जस्तै हुन्छ।

समग्रमा भन्नुपर्दा, विधिको शासनले कानुनमार्फत न्याय सुनिश्चित गर्छ भने कानुनद्वारा शासनले कानुनलाई शासकहरूले जनतालाई नियन्त्रण र दमन गर्ने औजारको रूपमा मात्र प्रयोग गर्छन्

एउटा मात्र स्रोत, अर्थात् डा. एनडी लामा द्वारा लिखित "एकाधिकारबाट आधुनिकतातर्फ: नेपालमा डिग्री मान्यताको पुनरावलोकन" शीर्षकको लेखले नेपालमा विदेशी शैक्षिक उपाधिहरूलाई मान्यता दिने प्रणालीको आलोचना गरेको छ। लेखकले त्रिभुवन विश्वविद्यालय (त्रिवि)राष्ट्रिय परीक्षा बोर्ड (एनईबी) द्वारा सञ्चालित वर्तमान समता प्रणालीलाई पुरानो, नियन्त्रणमुखी र अनावश्यक रूपमा कागजी प्रक्रियामा आधारित भन्दै आलोचना गरेका छन्। यस लेखले लेखकको आफ्नै र उनकी छोरीको शिक्षा मान्यता प्राप्तिको व्यक्तिगत संघर्षलाई उदाहरणको रूपमा प्रयोग गर्दै, जीईडी (GED) जस्ता अन्तर्राष्ट्रिय रूपमा स्वीकृत विकल्पहरूलाई पनि कसरी अस्वीकार गरिन्छ भन्ने स्पष्ट पारेको छ। समाधानका लागि, लेखकले स्वतन्त्र मूल्याङ्कन एजेन्सीहरूराष्ट्रिय योग्यता संरचना (NQF) मा आधारित आधुनिक अन्तर्राष्ट्रिय मापदण्डहरू अपनाउन सुझाव दिँदै, शिक्षा मन्त्रालय अन्तर्गत राष्ट्रिय योग्यता मान्यता परिषद् (NQRC) स्थापना गर्ने प्रस्ताव गरेका छन्।
